5. User Conduct and Acceptable Use Policy

When using MOONCHARTS services, you agree to:

7. Third-Party Services

MOONCHARTS integrates with third-party services including but not limited to:

• Stripe: For card payment processing and subscription management. Your use of Stripe is subject to Stripe's Terms of Service and Privacy Policy.
• NOWPayments: For cryptocurrency payment processing. When you pay with crypto, your transaction is processed by NOWPayments and subject to their Terms of Service and Privacy Policy. MOONCHARTS does not hold or control cryptocurrency funds at any point.
• Discord: For community features and authentication. Your use of Discord is subject to Discord's Terms of Service and Privacy Policy.
• YouTube: For video content delivery. Your use of YouTube is subject to YouTube's Terms of Service.

We are not responsible for the practices, policies, or content of these third-party services. Your interactions with third-party services are solely between you and the third party.

8. Intellectual Property

All content, including but not limited to text, graphics, logos, and software, is the property of MOONCHARTS and is protected by copyright laws.

9. Limitation of Liability

12. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms of Service or your use of MOONCHARTS services, you agree to first attempt to resolve the dispute informally by contacting us. If the dispute cannot be resolved within 30 days, both parties agree to resolve the dispute through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

Any arbitration will be conducted by a single arbitrator in accordance with the rules of French arbitration law and procedures. The arbitration will take place in France. The arbitrator's decision will be final and binding. You agree to waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration.

13. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought exclusively in the courts of France, and you hereby consent to personal jurisdiction and venue therein.

15. Subscriptions and Payments

All subscription purchases are final. We do not offer refunds for any subscription plans, including but not limited to Apprentice and VIP memberships. By purchasing a subscription, you acknowledge and agree to this no-refund policy.

Card Subscriptions (Stripe): Subscriptions paid by card are billed automatically on a monthly recurring basis. You may cancel at any time through the customer portal; access continues until the end of the current billing period.

Cryptocurrency Payments (NOWPayments): Crypto payments are one-time purchases that grant access for a fixed duration (1, 3, 6, or 12 months). They are not recurring — access will expire at the end of the purchased period and must be renewed manually. It is your responsibility to renew before expiry to maintain uninterrupted access. MOONCHARTS is not responsible for expired access due to failure to renew.

Cryptocurrency payments are processed by NOWPayments. If an incorrect or insufficient amount is sent, the order will be marked as unresolved and access may not be granted. In such cases, please contact us at support@mooncharts.fr with your payment details.

16. Subscription Management

Members are solely responsible for managing their own subscriptions, including renewals, cancellations, and payment method updates. You can manage your subscription settings through your account dashboard or through the payment provider's portal. It is your responsibility to cancel your subscription before the next billing cycle if you wish to avoid future charges.

17. Account Termination

We reserve the right to suspend or terminate accounts that violate these terms of service. No refunds will be provided for terminated accounts.

18. Changes to Terms

We reserve the right to modify these terms at any time. Users will be notified of significant changes.
